1.1 Agreement Overview Welcome to our Terms of Use! This document represents a binding agreement ("Agreement") between you ("User") and Evgeny Kreger ("Provider"), regulating the use of mobile applications. By accessing or using the app, you confirm your acceptance of these terms. 1.2 Terms and Definitions Effective Date: The date on which this Agreement becomes active. User Content: Includes photos, videos, or music created or uploaded within the app by the User. Mobile Application: Refers to the "English Kit" software intended for use on mobile devices. Device: Any smartphone, tablet, or similar device capable of running the application. Trial Period: A time-limited free access to the app's services. Services: The various functionalities and features available within the application. Subscription: Grants full access to Services, often with automatic renewal. Subscription Term: The active duration of a subscription. Subscription Fees: Costs associated with obtaining a subscription. Free Term: A period of no-cost access with restricted features. Free Services: Functionalities provided without charge. Tariffs: Different pricing plans for subscriptions based on available services. 2. SERVICES The Provider grants a personal, non-transferable license to use the application. Services include content creation tools, optional in-app purchases, and more. During the Free Term, Free Services may be accessed with potential limitations or reduced functionality, subject to the Provider's modifications. 3. AUTHORIZATION The Provider authorizes the User to access and use the app. Users must register via the app store, provide required information, and accept that the Provider processes personal data in accordance with the Privacy Policy. Users are solely responsible for keeping their accounts secure. 4. CONTENT Users retain ownership of their User Content but grant the Provider a license to use, store, and process it. Users must ensure the legality of their content, and the Provider disclaims liability for any loss of User Content. 5. USER RESTRICTIONS Users must comply with all legal and contractual obligations. They are prohibited from reverse engineering, duplicating, or sharing unauthorized versions of the app. Usage for illegal or harmful activities is strictly forbidden. 6. PROVIDER'S AND USER'S OBLIGATIONS The Provider commits to delivering Services with reasonable care and expertise. Users are required to pay Subscription Fees on time, protect their accounts, and adhere to applicable laws and regulations. 7. TERM AND TERMINATION This Agreement starts on the Effective Date. Either party may terminate the Agreement under specific conditions. Upon termination, access to Services will end. 8. FEES; PAYMENT TERMS Certain app features require payment. Subscription Fees are charged according to the chosen Tariffs. All purchases, including in-app content, are managed by the Provider. 9. LIABILITY The app is provided "as is," without warranties. The Provider is not liable for User Content or interruptions in app availability. Users agree to indemnify the Provider against claims or damages, with the Provider's liability being limited. 10. GOVERNING LAW AND JURISDICTION These terms are governed by the laws of the Republic of Georgia. 11. FINAL PROVISIONS The relationship between the parties is that of independent contractors. All data processing aligns with the Privacy Policy. The Provider reserves the right to pause Services for maintenance. These Terms represent the entire agreement between the parties.
